Dept. of Natural Resources <br />Pursuant to the requirement created by your letter of June 28, 1983, <br />Blue Ribbon has prepared an additional response in regard to stipulation <br />No. 3 in the CMLRD proposed decision document for permit No. C-047-81. <br />The stipulation is: <br />Blue Ribbon Coal Company shall provide an acceptable stability <br />analysis of the proposed backfilled configuration of all mine <br />facilities and the haul road, including an appropriate material <br />shear strength testing report. This stability analysis shall <br />demonstrate compliance with the static slope safety factor <br />requirements of Rule 4.27.4(1). This acceptable stability <br />analysis shall be submitted to the division within 60 days of <br />permit issuance. <br />Our original response can be found in our document titled, Blue <br />Ribbon Coal Company Stipulation Response Document, dated February 10, <br />1983. <br />We have discussed your June 28, 1983 letter with Rocky Mountain <br />Geotechnical, Inc. in Colorado Springs, Colorado over the past weeks. <br />Our additional response is included herein and is organized by the <br />table of contents which follows this letter. The mine bench has <br />encountered additional movement this spring as was noted by Mr. Pendleton. <br />It is the mine's opinion that,with the precautions being taken, operations <br />can continue safely. This response focuses on the reclamation phase. <br />Due to the operating problems which the mine has encountered in the <br />recent past, a site inspection where the technical aspects of the mine <br />reclamation plan get a further review may be a good idea. If your <br />office would like to participate in this, either Larry Reschke or <br />myself, and a representative from Rocky Mountain Geotechnical would <br />welcome the opportunity. Since we believe that the mine is operating <br />safely at this time, there should be no urgency for the field inspection. <br />
