. ,~ <br />May 4, ?000 <br />Page 3 <br />Inquiry #2 -What can be done to maintain Picketwire in temporary cessation, until operations <br />become feasible? In this scenario, would there be any time constraint !o Picketwire's temporary <br />cessation stat:~s? <br />DMG Response -The New Elk loadout is currently in Temporary Cessation, and can remain in <br />this status as long as appropriate. There are no specific regulatory timeframes to guide this <br />decision; however, the DMG must consider whether operations can be reasonably expected to <br />resume. We must consider factors such as market, source of coal, etc. We also require that the site <br />be maintained in conformance with all applicable performance standards at all times. If the site <br />compliance is not maintained then enforcement actions would occur. Such actions could result in <br />an order to reclaim the project and/or could lead to permit revocation. <br />Inquiry #3 -What can we do to maintain our permits and avoid reclamation, until the market <br />conditions allow us to mine and process the coal? <br />DMG Response -The Lorencito permit term may be extended, if appropriate, as described in #1 <br />above. The New Elk permit may remain in temporary cessation, if appropriate, as described in #2 <br />above. <br />Issues Discussed during the May 3, 2000 meeting - <br />-A permit transfer can be accomplished by complying with procedures and requirements <br />of Rule 2.08.6. <br />-A bond must be in place to maintain the Lorencito Permit. The bond amount may be <br />based upon a cumulative bond schedule, if various requirements are met.
