Summary and Conclusions
<br />Based upon a review of the approved permit application, the applicant's bond release application,
<br />and site inspections,the Division finds that P&M has completed backfilling, grading and drainage
<br />reestablishmentonthe proposed release areas in accordance with the approved reclamation plan.
<br />IV. PROPOSED DECISION
<br />Based on the observations above, the Division proposes to approve P&M's request for Phase I
<br />bond release on portions of the Edna Mine. This proposed decision will release the applicant
<br />from liability for backfilling, grading, and drainage reestablishment on the West Ridge azea and
<br />a portion of the Center Ridge azea. The specific areas aze located in Township 4 North, Range
<br />86 West of the 6th Principal Meridian, further described as follows:

<br />The Division holds a performance bond of $7,171,716.00 for the Edna Mine. The Division
<br />proposes to release $821,613.00. The remaining $6,350,103.00 is sufficient to assure completion
<br />of the remaining reclamation work at the site if the work had to be performed by the Division,
<br />including the cost of reestablishing vegetation on any revegetated areas, should those areas fail.
<br />The Division estimates its cost to complete remaining reclamation work at the site to be
<br />$6,350,103.00.
<br />There is no remaining reclamation work which remains to be done in the proposed release azea.
<br />The Division is, however, retaining that portion of the performance bond that applies to topsoil
<br />redistribution and revegetation, since a request for Phase II or III release has not yet been granted.
<br />The entire performance bond is being retained for the remainder of all permitted areas other than
<br />the proposed release azea.
