Box 591 <br />Lamar, Colorado 81052 <br />Re: Lamar East Pit, File No. M-77-572 <br />Dear Mr. Gregg: <br />Enclosed is a letter received by the Division from the Colorado Department of <br />Highways (CDOH), The letter expresses concerns about possible effects the <br />Lamar East operation might have on an adjacent CDOH structure. CDOH raises <br />serious hydrologic and geotechnical concerns about the safety of the mining <br />operation in relation to the overtopping of Highway 50, and erosion of bridge <br />foundations during high flow periods, <br />According to C.R,S. 34-32-115 4(d): <br />"A permit shall not be denied except for one or more of the following <br />reasons: <br />The mining operation will adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located within <br />two hundred feet of the affected land, except where there is an <br />agreement between the operator and the persons having an intere:~t in <br />the structure that damage to the structure is to be compensated for by <br />the operator," <br />Also, your permit specifically states "This permit is issued subject to all <br />requirements of the Colorado Mined Land Reclamation act and all rules, <br />regulations and standards now in force and any which may in the future be <br />promulgated by the Mined Land Reclamation Board, and this permit may be <br />revoked or suspended for noncompliance with the Act and/or such rules, <br />regulations and standards." <br />Because of the potential severity of the situation, the Division feels that <br />Valco, Inc, should provide proof that its Lamar East operation does not affect <br />the stability of the CDOH structure in question, or any other man-made <br />structures located within 200 feet of the affected area.
