B. The applicant has not submitted a plan for disposal, at the approved disposal area
within the permit boundary, of mine waste materials generated by activities
outside the permit boundary (4.10.1(2)).
C. The disposal area will be inspected on a regular basis by a qualified professional
engineer, experienced in construction of similar earth and waste structures
(4.10.2(1)).
D. An alternative subdrainage system for the coal mine waste azea has not been
proposed. The Division finds that the approved subdrainage system should ensure
the applicable static safety factor, stability of the fill, and protection of the surface
and ground waters (4.10.3(5)).
E. The Division is not proposing to approve a variation in the requirements for
maximum allowable lift thickness and minimum required compaction
(4.10.4(3)(a)).
IX. Coal Mine Waste
A. Non-coal waste will be stored at designated locations at the mine site, then
transported to the Delta County landfill for proper disposal.
X. Backfilling and Grading
A. BRL will reclaim the mine site to achieve approximate original contour. All
highwalls will be eliminated during reclamation. BRL has not requested any
variances regazding backfilling and grading, nor are any approved with this
decision document.
XI. Revegetation
Information regarding baseline vegetation studies maybe found in Section 2.04.10 of the
permit. Information regarding revegetation of disturbed areas maybe found in Section
2.05.4 of the permit. The goal of revegetation efforts at the Bowie No. 2 Mine is to
reestablish apost-mining land use of rangeland and wildlife habitat. Disturbed azeas will
be seeded with one of two seed mixes, and straw mulch will be applied at a rate of 4000
pounds per acre.
A. The Division approved the use of introduced species in the reclamation seed mix.
The applicant has submitted information which shows that the introduced species
aze desirable and necessary to achieve the approved post-mining land use and are
not poisonous or noxious (4.15.2(3)). However, the lists of introduced species for
seed mix no. 2, meadow, and for seed mix no. 3, upland, were revised in Permit
Renewal No. 1. Introduced species in the meadow seed mix include Poa pratensis
(Kentucky bluegrass), Medicago sativa (Alfalfa), Medicago officianlis (Yellow
sweetclover), and Astragalus cicer (Cicer milkvetch).
