Capt. of A~atural flesourc~
Dear Joe,
This letter is intended to address some negative response I"ve
received on the wildlife preservation concept with parcel "A"
of the West Rifle Pit amendment. Division of Wildlife although
strongly encouraging this designation is reluctant to have title
dedicated to themselves. The only options they could offer were
to keep title by Mr. White, dedicate title to City of Rifle or
dedicate title to Garfield County.
Mr. [dhite could ask the county assessor for a conservation ease-
ment but any benefits of dedication or release of tax liability
would be negated. This leaves this option without any advantage
to offset purchase price and other costs of obtaining the parcel.
I don't believe it is a viable option.
The City of Rifle has not affirmed acceptance to date. The planning
staff discouraged the cities present participation. Ted Anderson,
the City Manager, reported he would advise me by letter as soon
as a decision is made.
Garfield County has suggested the future availability of Conser-
vation Trust Funds (re Colorado State Lottery) as being a possible
means for acceptance. Stan Brome, the County Administrator, was
encouraging and I think something can be worked out with Garfield
County. I have not requested the counties approval as I feel ob-
ligated to wait Rifle's decision first.
I think it is incumbent upon me to address the possibility of fail-
ing to find an agency willing to accept this encumbered land dedi-
cation. I would propose that at our annual report filing date, we
review progress and if necessary submit a technical revision delet-
ing Parcel A from the mining plan and the reclamation provisions.
I sincerely hope that this will not be necessary. I think Mr. White
has a good program and has tried to work with the Division of [dild-
life and others concerned. Let me know if you have any other input
or suggestions in this matter.
V ry Truly Yours
H ward E Tingley
cc R.E. White
