Catlany <br />Division Director <br />Natural Resource Trustee <br />On January 20`h 2004, I called you to inform you of a Division decision regarding the <br />construction of a portion of 120`h Avenue and adike/haul road, in Albert Frei and Sons' <br />(A F and S) M&G Pit reclamation permit area. The dike transects the permit area and <br />was constructed to provide a route for hauling material from the Dunes Pit (Permit No. <br />M-1999-093) to the 120`h Avenue project. What I told you was that, just prior to the <br />construction of the roads, the Division had inspected A F and S's reclamation of the <br />M&G Pit and that the reclamation work had been adequately completed in the areas <br />affected by the construction of the roads. 1 also told you that, since the reclamation had <br />been completed, the Division had informed Albert Frei and Sons, through their consultant <br />Steve O'Brien, that, if they would submit a request, the Division would release them <br />from further reclamation responsibility for the two road areas. The Division wanted you <br />to have this information, because we had previously told you, A F and S, and Adams <br />County that the permit would have to be revised to reflect the construction of the roads. <br />The Department of Transportation had offered to help A F and S with the revision. <br />Albert Frei and Sons has already requested to be released from reclamation responsibility <br />for the area involved in 120th Avenue construction and the Division will approve that <br />request. However, Ben Frei stated to the Division, on January 21, 2004, that his company <br />does not, at this time, intend to request to be released from that portion of the permit area <br />affected by the construction of the dike/haul road. Therefore, if the dike/haul road is to <br />remain in the permit area, the permit will have to be revised. I am providing you this <br />information in the event that you still want to assist Albert Frei and Sons with a revision <br />of their permit. Of course, the decision to leave the dike/haul road would have to be <br />approved by the landowner. <br />Please call me if you have questions regarding this letter.
