Steve Renner - 2 - February 25, 1991 <br />7. Protection of livestock and wildlife - I am presuming he is <br />referring to erosion caused by the haul road. This was heard at <br />the 1986 and 1989 Board hearings. <br />8. Clarification of responsibilities - I presume he wants to know what <br />he can do or not do and where. This has been indirectly addressed <br />by the 1989 hearing but was a major subject of debate at the <br />January 1991 Routt County Court hearing. So I guess I would let <br />him talk to the Board about it except it does relate to the haul <br />road? <br />9. Clarification of inspection reports (rodents causing erosion) - I <br />have no idea what clarification he wants. The rodent hole was <br />along the haul road released by the Board in 1989. <br />10. Ditches in ditches on road - Subject of 1986 and 1989 Board hearing. <br />11. Routt County District Court Order - Not subject of any Board <br />hearings, and doesn't involve the Division. <br />12. Not allowed to conduct further mining since 1983 - Not subject of <br />hearing previously. We never prevented Sun Coal from mining. <br />Shutting down was their decision. <br />13. All structures to remain - Not subject of previous hearing. The <br />mining lease between Sun Coal and Mr. Eilts indicates that he will <br />receive structures at the end of use of the property for mining <br />purposes. <br />As you can see it is impossible to discern what his concerns exactly are in <br />some cases. Some of these items are not within our arena. Others hardly seem <br />like items for the Board, but..... <br />SJM/yjb <br />3625E <br />
