~ r <br />The holder shall control noxious weeds within the right-of-way as directed <br />Authorized Officet. <br />`'~ k. The carrying of firearms by employees of the holder, and all contractors and <br />Nbcontractors and their employees, while on the job or in company-owned vehicles, <br />yith the exception of security guards, shall be prohibited. <br />1. The holder shall take any action necessary to suppress any fugitive dust <br />resulting from construction, ash handling, transportation, and disposal ae approved <br />by the Authorized Officer. <br />m. All construction activity shall cease when soils or road surfaces become <br />saturated to a depth of 3 inches, unless otherwise approved by the Authorized Officer. <br />n. If any fossils are discovered during construction, the holder shall immediately <br />notify the Authorized Officer for a determination of the significance of the discovery. <br />o. The holder shall promptly remove all trash, litter and excess construction <br />material from the right-of-way and shall dispose of such wastes at a sanitary landfill. <br />p. Disturbed areas along the refuse haul route shall be reseeded in accordance <br />with the methods contained in the mining permit application for the Moon Lake Power Plant <br />Project, Units 1 b 2, approved by the Office of Surface Mining. The mixture shall be <br />unattractive to mule deer and shall be approved by the Authorized Officer. <br />q. The holder shall reclaim within a period of time, not to exceed two years from <br />commencement of use of the refuse haul road, the portions of the existing road which <br />are replaced by the refuse haul road according to the Authorized Officer's specifications. <br />r. No disturbance of prairie dog towns will be allowed until a formal survey has <br />been made to determine if the black-footed ferret has definitely been extirpated from <br />the area. The USFWS may accept prior studies done in the area and may provide a written <br />waiver of this measure to the Authorized Officer who will then allow construction to <br />proceed. Location of black-footed ferrets would require further mitigation to be <br />determined at that time. <br />e. The holder shall paint and maintain all visible conveyor facilities, including <br />the cover, support structures, and transfer stations with a non-reflective earth-tone <br />paint satisfactory to the Authorized Officer. <br />t. The holder shall control coal dust by covering conveyors and spraying the reserve <br />coal storage piles with a surface crusting agent. <br />u. All internal combustion engines used by the holder on the right-of-way shall be <br />equipped with properly maintained exhaust mufflers or spark arrestors as approved by the <br />Authorized Officer. <br />v. The holder agrees to comply with the Moon Lake Power Plant Project, Units 1 6 2, <br />Wildlife Mitigation Plan, a copy of which is filed in case file C-30119 in the Colorado <br />State Office, Bureau of Land Management. This Wildlife Mitigation Plan is hereby incor- <br />porated by reference and made a part hereof. In the event of a conflict between any item <br />in said plan and the terms, conditions and stipulations of this grant, the terms, conditions, <br />and stipulations of this grant shall prevail unless otherwise determined by the licensor. <br />w. The holder shall provide appropriate road signs, barricades, flagmen, and other <br />necessary safety measures to insure public safety during the construction of the project <br />authorized herein. At the request of the Authorized Officer, additional safety measures <br />shall be provided by the holder. <br />x. The holder shall construct mule deer and pronghorn crossing structures along <br />the conveyor route in accordance with the locations and structure style specifications <br />outlined on the Overland Conveyor and Maintenance Plan b Road Profile Map, a copy <br />of which is filed in case file C-30119 in the Colorado State Office, Bureau of Land <br />Management. <br />y. Prior to final abandonment, the holder shall submit a plan of abandonment to <br />include soil stabilization measures, and rehabilitation and restoration procedures. <br />Page 5 of 6 <br />
