Long, <br />Division Director <br />RE: Research into status of stipulations <br />I have done more research into the stipulations that I had asked <br />Kathy welt about in my adequacy letter dated June 1, 1992. The <br />following is a summary of what I found. <br />PART III: BTIPQLATIONB <br />1. Stipulation 32 (Stip. 7 from PR #2 and #4: The date of <br />origination of this stipulation was 1985. I think the panel is <br />Section 20 and I think that it has already been mined and retreat <br />mined. The wells might be either/or SOM 38-H2, SOM 38-H3, SW-1, <br />and SOM C-72H. The subsidence monitoring plan can be found in <br />Exhibit 60. I reached no conclusion on the status of this <br />stipulation, because I am not sure where they are in their mine <br />plan. <br />4. Stipulation 33 from the original application: There is no <br />longer an initial waste pile. This was the plan in the original <br />permit application. Since that time, the area that was to be the <br />initial waste pile was needed for a bench to expand the shop area. <br />All the waste that had been stored up to that point was removed <br />before construction began. See page 2.05-35 in the permit <br />document. Therefore, this stipulation is resolved and will not be <br />entered onto the computer system as it never was originally <br />entered. <br />5. Stipulation 34 from the original application: All the studies, <br />permit term and >_t was determined that all the items required in <br />the stipulation would not have to be done until the pile was to be <br />built. The revision was submitted in 1984, but to date the pile <br />has not been built. Also, as a result of this revision some <br />additional stipulations were imposed which replaced this <br />stipulation. They are Stipulations 6, 7, 10, and 11; to limit <br />analysis, etc. for the upper waste pile was completed and submitted <br />as Permit Revision #4 and can be found in Exhibit 50 in the permit <br />document. When the stipulation was originally imposed, the company <br />told the Division that the pile was not planned for the first <br />
