Long <br />Division Dneonr <br />RE: Well Permit for Hazel-A Adit, Gold Hill Mill, Colina Oro Molino, <br />Inc., File No. M-94-117 <br />Dear Mr. Fanyo: <br />On January 25, 1996, Colina Oro Molino (COM), Inc. and the Division of <br />Minerals and Geology (DMG) provided an update to the Colorado Mined Land <br />Reclamation Board (Board) on the status of the Gold Hill Mill as it <br />relates to Reclamation Permit No. M-94-117. During that status update, <br />Board Member James Cooley inquired as to the water rights aspects of <br />evaporation-of ground water collected in the Hazel-A adit and pumped up <br />to the Gold Hill Mill tailing pond. In following-up the Board's inquiry, <br />DMG has determined that regulations administered by the Division of Water <br />Resources specify that a Well Permit is required for the use of ground <br />water. Since the water collected in the Hazel-A is consumptively used <br />(evaporated), a court approved augmentation plan or a substitute supply <br />plan approved by the State Engineer will be required before a Well Permit <br />can be issued. Also, since ground water collected in the Hazel-A Adit is <br />not obtained from a cased well, a request for a variance to the Water Well <br />Construction Rules will likely be required. <br />Please contact the Office of the State Engineer to obtain an application <br />for a Well Permit, and be prepared to update the Mined Land Reclamation <br />Board on the status of water rights issues at the Gold Hill Mill during <br />the February 21-22, 1996 meeting of the Board. <br />If you have any questions, please contact me. <br />Sincerely, <br />~` / ~ :~ <br />v''~~' %y' ( ~ Ci <br />` ;: <br />Atlen C.
