<br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, Trapper Mining, Inc. is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R. <br />(2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4; <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />Haul roads are discussed under Section 3.7.2, vol. III of the <br />permit application. <br />1. The Division proposes to approve a temporary ford of an <br />ephemeral or intermittent stream having a watershed of at <br />least one square mile during the construction period since it <br />will not alter normal water flow, contribute sediment, or <br />adversely affect fish or wildlife. All road construction <br />occurs upstream of adequate sediment control facilities. The <br />approved drainages for this activity are Coyote, Johnson, No <br />Name, and East Pyeatt. (4 .03.1(2)(c)). <br />B. Access Roads <br />Access roads are discussed under Section 3.7.3, vol. III of the <br />permit application. <br />1. The ford of an ephemeral stream with a watershed of at least <br />one square mile proposed for approval since it will not <br />seriously alter normal water flow, contribute to sediment <br />load, or cause adverse affects to fish or wildlife. The fords <br />may occur in the Coyote, Johnson, No Name, and East Pyeatt <br />drainages. Adequate sediment control facilities exist <br />downstream of all fords except the West Pyeatt ford. <br />(4 .03.2 (2)(c)). <br />II. Suooort Facilities - Rule 4.04 <br />Support facilities are discussed under Section 3.8, Vol. III of the <br />permit application. <br />A. Construction of support facilities will not result in damage, <br />destruction, or disruption of oil, gas, or water wells or <br />pipelines, coal slurry pipelines, railroads, or utility lines <br />which pass over, under, or through the permit area. Utility <br />lines and a gas line pass through the permit area but are only <br />affected by the pit areas and not support facilities. Written <br />approval from the owner of the affected facilities has been <br />submitted. Therefore the Division proposes to approve those <br />activities. (4.04(6)). <br />III. Hvdroloaic Balance - Rule 4.05 <br />A. Water Quality Standards and fiffluent Limitations <br />Surface discharge at the Trapper Mine ie monitored under NPDES <br />permit # CO-0032115 issued by the Colorado Department of Health. <br />In addition, the applicant has semi-annual requirements imposed by <br />the Division ae part of its surface water monitoring program. <br />Acute toxicity testing through biomonitoring sampling is required <br />Page 16 <br />
