<br /> <br />Findings of the <br />Colorado Division of Minerals and Geology <br />for the <br />Trapper Mine <br />Explanation of Findings <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, and the approved state program, the <br />Division of Minerals and Geology or the Hoard must make specific written <br />findings prior to issuance of a permit, permit renewal or permit revision. <br />These findings are based on information made available to the Division that <br />demonstrates that the applicant will be able to operate in compliance with the <br />Colorado Surface Coal Mining Reclamation Act and the Regulations promulgated <br />pursuant to the Act. <br />The findings in the following sections required by Rule 2.07.6(2) are listed <br />in accordance with that Rule. The findings and specific.approvals required <br />pursuant to Rule 2.07.6(2)(m) are listed in accordance with Rule 4 and are <br />organi2ed under subject or discipline subtitles. <br />This findings document is updated upon permit renewal, which occurs every five <br />years for most mines. This ie the renewal findings document for the Trapper <br />Mine, which has a five year permit term. The applicant also filed a permit <br />revision (PR-03) concurrent with the renewal application. The following <br />findings were reevaluated and updated if necessary to reflect changes which <br />have occurred during the past permit term. <br />STIPULATIONS <br />Stipulations are a binding part of the permit and previously assigned <br />stipulation numbers cannot be re-used. Some confusion originated due to <br />stipulation numbering of some of the original stipulations. Therefore a <br />general investigation and subsequent re-numbering was undertaken during the <br />1993 Pindings update. The following brief discussion is an attempt to clarify <br />the stipulation history. <br />in the 1982 findings three stipulations were issued. Stipulation No. 1 dealt <br />with the criteria for evaluation of herbacious cover and productivity. <br />Stipulation No. 2 required the operator to monitor post-mining topography <br />annually and submit the results to the Division. Stipulation No. 3 required <br />the operator to verify the 25ir swell factor. Stipulations No. 1 and 3 were <br />satisfied and duly noted in the 1987 findings associated with PR-O1. However, <br />Stipulation No. 2 was still active at this time. The 1988 findings update <br />associated with PR-02/RN-O1 added a new Stipulation No. 4 which required the <br />monitoring of level and quality of the Lux well located northwest of the mine <br />permit area. None of the aforementioned stipulations were properly entered in <br />the Division tracking system. After 1988, eight stipulations were generated <br />and complied with during the course of revisions to the permit. Since <br />stipulation numbers cannot be re-used the following was done to record the <br />first four missing stipulations. Stipulations No. 1-8 will stay as currently <br />numbered. Original stipulations nos. 1-4 will become nos. 9-12 respectively. <br />Therefore the active stipulations as of this 1993 findings update are: <br />STIP NO. 10 <br />THE DIVISION DIRECTS THfi PfiRMITTEE TO MONITOR THE POST-MINING TOPOGRAPHY OF <br />THE BACKFILLED AND REGRADED SURFACES OF THE DISTURBED AREA AT THE TRAPPER <br />MINE. MONITORING FOR THIS PURPOSE SHALL CONSIST OF A CONTOUR MAP (CONTOIIR <br />INTERVAL NOT TO EXCEED 5 FEET) PRODUCED FROM AN ANNUAL SURVEY UTILIZING FIELD <br />OR AERIAL PHOTOGRAMMETRIC TSCHNIQIIES ACCEPTAHLH TO THfi DIVISION. THE POST- <br />MINING TOPOGRAPHIC MAPS SHALL BS SUBMITTED TO THE DIVISION FOR REVIEW AND <br />APPROVAL ON AN ANNUAL BASIS, COMMENCING IN JANUARY, 1984. <br />Page 8 <br />
