Schmidt, P.E. <br />On December 2, 1994 you faxed a copy of a letter written on <br />November 9, 1994, on the access road was crackefl to our hunting <br />cabin in Section 20 up from Lona Pine Gulch. <br />We understand that you want us to let you know that we are 3n <br />receipt of your letter, but you must understand that we do not <br />agree with the fact that the mining at Mountain Coal Company had <br />very little to do with the road cracking and falling. <br />Phil, please understand that the spot where the road gave away <br />and fell has been in the same place prior to us owning the ranch, <br />and NO new construction took place on the sight of the cracks. <br />Or1 November 4, 1994 when you were notified about the road cracks, <br />Henry Barb excepted responsibility immediately, you were asked to <br />wait to do the repairs because of hunting season and we had <br />hunters at the cabin and 1n that area. When a lot of noise and <br />new vehieles or equipment is brought into a hunting area the game <br />moves or leaves the area all together, and for this reason you <br />were asked to wait to fix the road. <br />Please contact us if you have any questions.
