Gig,!. o. ~"aWlal !;~:;c,iuces <br />Today at the meeting held by the MLRB staff on the Colorado coal <br />regulations you said that the MLRB staff would not consider the Flatiron <br />Bourg mine as a federal mine and that the fact that the access road <br />to the mine crosses federal land did not cause the mine to be classified <br />as a federal mine. You mentioned that the MLRB staff would oppose any <br />OSM attempt to designate the Bourg mine as a federal mine. <br />I appreciate your stand on this. I hope that when Dave clarifies <br />the question of what constitutes a federal mine he will verify that <br />an access road across federal property to a coal mine on private <br />acreage, mining coal when the mineral rights are privately held,-- that <br />such an access road does not change the private status of the private <br />mine. <br />Sincerely, <br />(DSrs. ) Margaret Winter <br />
