June 1993. Thereafter, the West Mine facilities were used for materials transport, a maintenance shop,
<br />ventilation and emergency escapeway.
<br />On November 5, 1987, Colorado Westmoreland Inc.'s application for renewal (RN-01) of a valid and existing
<br />permit to conduct coal mining operations, Permit No. C-81-038, was deemed complete. The Division published
<br />its proposed decision to approve the revision with ten stipulations on August 4, 1988, and amended the permit
<br />decision of Mazch 21, 1983 by renumbering the permit as C-81-038 to ensure consistency within the MLRD
<br />files. Permit C-81-038 was issued by the Division on July 2l, 1988. However, this date was in error; the permit
<br />issuance should have been April 20, 1988. In order to remedy this situation, the 1993 permit renewal issuance
<br />date was back-dated to Apri120, 1993, with a permit expiration date of April 20, 1998.
<br />The Division issued a decision on August l0, 1989 to approve the transfer of mining permit C-81-038 from
<br />Colorado Westmoreland Inc. to Cyprus Orchard Valley Coal Corporation (COVCC).
<br />On January 21, 1993, Cyprus Orchard Valley Coal Corporation submitted an application for Permit Renewal
<br />No. 2 (RN-02). The proposed decision to approve with conditions RN-02 was made on July 23, 1993. The
<br />decision became final on August 23, 1993. Due to the error in assigning the correct permit issuance date in
<br />1988, the Permit Renewal No. 2 issuance date was back-dated to April 20, 1993 and the expiration date became
<br />April 20, 1998. Stipulations numbers 26, 27, 28, 34, 41, 42 and 43 were attached to RN-02.
<br />On April 28, 1993, Permit Revision No. 3 (PR-03) was submitted by COVCC for the inclusion of 510 acres into
<br />the permit area, as a result of the new coal lease COC-53356. The permit revision, with ten stipulations attached,
<br />was approved on July 30, 1993.
<br />On May 22, 1993, Technical Revision No. 22 was approved. This TR added sixty acres onto the west side of the
<br />permit area, so that the permit boundary would include the angle of draw projected to the surface for coal (ease
<br />COC-372 l OM.
<br />On March 22, 1994, Technical Revision No. 24 was approved. In this TR, hydrologic monitoring of selected
<br />sites was either eliminated, temporarily discontinued or reduced in frequency. It was demonstrated that these
<br />sites were either located where there were no anticipated impacts from mining or where reduced monitoring
<br />frequency would not compromise an ability to determine hydrologic impacts. Hydrologic monitoring of some
<br />sites may be reinstated in the future should a change in the mine plan warrant it.
<br />On September 26, 1994, Technical Revision No. 25 was approved. A modification of the north end of the West
<br />Ridge Waste Pile, to increase the storage volume of the pile, was approved.
<br />On December 8, 1994, the Division received an application for a transfer of permit and succession of operator.
<br />With the approval on January 24, 1995, permit C-81-038 was transferred from Cyprus Orchard Valley Coal
<br />Corporation to Bowie Resources Limited (BRL).
<br />The operator for the Bowie No. I Mine was changed in Minor Revision No. 99, from Bruin Mining Company to
<br />Sherpa Paonia, Inc. MR-99 was approved with conditions on January 21, ! 997. Stipulation no. 52 was attached
<br />to MR-99 and approved the transfer conditional upon the continued compliance with a settlement agreement that
<br />had been linked to the operator. With Technical Revision No. 28, the operator was changed from Sherpa Paonia
<br />to BRL.
<br />BRL submitted the Permit Renewal No. 3 (RN-03) package on October 20, 1997. After all of the Division's
<br />adequacy review issues were resolved, Permit No. C-81-038 was renewed for the Bowie No. 1 Mine, retroactive
<br />to April 20, 1998.
