LOng <br />Y 9Y 4 P Yr nDrrecia <br />Raton Creek Minea, Permit No. C-82-055 <br />Dear Mr. Iuppa: <br />Thank you for your letter of July 27, 1994 regarding the removal of <br />certain mine-related structures at the Raton Creek Mines. I'd like <br />to take this opportunity to provide a response, in an effort to <br />address your concerns. <br />In reading your letter, I understand you believe you have no say as <br />a landowner in how Energy Fuels Mining Company reclaims the Raton <br />Creek Mines. This is not correct. In the August 16, 1992 renewal <br />of the Raton Creek Mines permit, the Division specifically <br />requested Energy Fuels Mining Company submit to the Division <br />"copies of written comments concerning the proposed post-mining <br />land use from the surface owners of the permitted area" <br />(Stipulation No. 12). A copy of this renewed permit with this <br />language is provided for your benefit. As can be seen, the <br />Division is very concerned with comments from landowners regarding <br />post-mining land use changes. <br />In consultation with Division personnel, it is my understanding <br />that Energy Fuels' recent Technical Revision TR-14, that addressed <br />changes in the reclamation of the Raton Creek Mines, was approved <br />specifically without references to the mine structures, in an <br />effort to address your concerns as a separate subsequent issue. As <br />such, I see no reason why discussions regarding which mine <br />buildings may remain shouldn't continue. <br />I have passed your letter along to Division personnel and to Energy <br />Fuels Mining Company. We will contact Energy Fuels shortly, to <br />request they consider your comments in the preparation of the <br />demonstrations they are developing in accordance with Section <br />2.05.5(2)(d) of the Colorado Mined Land Reclamation Board's <br />Regulation for Coal Mining. I am sure Energy Fuels would wish to <br />accommodate your desires as much as possible. <br />
