D <br />JAN2o}„ ~• <br />RE: Permit 79-177, Stipulation Number 5 <br />Gentlemen: <br />Stipulation Number 5 of the Energy Fuels Permit 79-177 required that: <br />"Six months after approval, the applicant shall submit for approval to the <br />regulatory authority, a narrative of the techniques and devices to be used <br />to establish the necessary watering areas for elk. The plan .shall also <br />include a map showing the location of the watering areas in relation to <br />the elk calving grounds". The rationale used by O.S.M. in requiring this <br />stipulation was discussed on p, 28 in the Environmental Assessment of <br />Section 816.97 of Energy Fuels Permit 79-177 as follows: <br />"Hydrologic studies have shown [hat after mining, the water available <br />for wildlife use will be sufficiently reduced. Lactating elk require <br />a large amount of water in close proximity to the calving ground <br />(Reichelt, 1973). If spring runoff is not available for the elk <br />during calving, the relocation of the calving grounds could be less <br />successful. Also, during reclamation of the traditional calving <br />grounds, after mining, watering sources need to be included. <br />Therefore, six (6) months after the approval of the mine plan appli- <br />cation, the applicant will submit for approval by the regulatory <br />authority, a narrative of the techniques and devices (i.e., guzzlers, <br />waterholes, and/or artificial springs) to be used to establish the <br />necessary watering areas. The plan will also include a map showing <br />the locations of the watering areas in relation [o the elk calving <br />grounds." <br />_, <br />
