D JAN2o}„ ~• RE: Permit 79-177, Stipulation Number 5 Gentlemen: Stipulation Number 5 of the Energy Fuels Permit 79-177 required that: "Six months after approval, the applicant shall submit for approval to the regulatory authority, a narrative of the techniques and devices to be used to establish the necessary watering areas for elk. The plan .shall also include a map showing the location of the watering areas in relation to the elk calving grounds". The rationale used by O.S.M. in requiring this stipulation was discussed on p, 28 in the Environmental Assessment of Section 816.97 of Energy Fuels Permit 79-177 as follows: "Hydrologic studies have shown [hat after mining, the water available for wildlife use will be sufficiently reduced. Lactating elk require a large amount of water in close proximity to the calving ground (Reichelt, 1973). If spring runoff is not available for the elk during calving, the relocation of the calving grounds could be less successful. Also, during reclamation of the traditional calving grounds, after mining, watering sources need to be included. Therefore, six (6) months after the approval of the mine plan appli- cation, the applicant will submit for approval by the regulatory authority, a narrative of the techniques and devices (i.e., guzzlers, waterholes, and/or artificial springs) to be used to establish the necessary watering areas. The plan will also include a map showing the locations of the watering areas in relation [o the elk calving grounds." _,
