As I told you at the time, we believe that ownership of Weld County <br />Road 6 1/4 has been conveyed to us as a result of a reversion clause in the warranty deed <br />to the Weld County Commissioners giving them the surface rights to County Road 6 1/4. <br />Recently Fort Lupton annexed the property now known as the Lupton Lakes Gravel <br />Project. This annexation encompassed the eastern half of County Road 6 1 /4. <br />Subsequently Fort Lupton vacated and abandoned for public use that portion of Road 6 <br />1/4 which was annexed. When the abandonment action occurred that triggered the <br />reversion clause in the above mentioned warranty deed. and conveyed that portion of <br />Road 6 1/4 to us. It is also my understanding that the Lupton Lakes Project gravel permit <br />does not include the portion of Road 6 1/4 abandoned as a public road. <br />Consequently I am requesting that you notify me and my attorney, Steve Bain, if the <br />operator of the Lupton Lakes Project applies for a technical revision or amendment to the <br />existing permit which would include the eastern one half of Road 6 1/4.
