<br />7 <br />slope measurements along this slope, which demonstrated an average gradient of 16.4° or <br />29% slope (standard deviation of 1.1). None of the individual slope measurements <br />exceeded 3h:ly. <br />Three temporary clean water diversion ditches exist on site. These are located on the <br />southern extent of the disturbed area boundary, and consist of Watershed Diversion No. 3, <br />Watershed Diversion No.4, and Watershed Diversion No. 5. The Division verified the <br />measurements of these diversions during the March 8, 1995 inspection, and found them to <br />be in compliance with the designed plans. These three diversion ditches are approved to <br />be removed prior to final bond release. <br />Five drainage control structures have been approved to remain as permanent structures. <br />These consist of Clean Water Diversion Ditches Nos. 1 and 2, Refuse Collection Ditches <br />Nos. 1 and 2, and the Starkville Gulch Permanent Stream Channel Diversion. Clean Water <br />Diversion Ditch No. 1 diverts undisturbed drainage above the reclaimed coal mine waste <br />bank, and directs it west of the sediment pond. Clean Water Diversion Ditch No. 2 directs <br />undisturbed drainage from upslope of the coal mine waste bank to the east, and <br />subsequently into the Starkville Gulch channel. These ditches have been designed in <br />accordance with Rule 4.09.2(7). Verification measurements of Clean Water Diversion <br />Ditches Nos. 1 and 2 taken at the time of the March 8, 1995 inspection demonstrated that <br />they were in compliance with the approved design specifications and regulatory <br />requirements. <br />Refuse Collection Ditches Nos. 1 and 2 collect runoff from the reclaimed coal mine waste <br />bank and direct it to the sediment pond. These ditches were inspected during the March <br />8, 1995 inspection, and found to be in compliance with their approved designs and with <br />regulatory requirements. <br />The fifth drainage control structure that will remain as a permanent structure after final <br />liability release is the permanent stream channel diversion of the Starkville Gulch. The <br />Starkville Gulch is an ephemeral drainage and has been designed in compliance with Rule <br />4.05.4(4). This diversion is composed of three segments. The uppermost upstream segment <br />is comprised of an eight-foot diameter culvert extending 675 feet. The middle segment <br />consists of an un-armored open channel extending 850 feet from the outlet of the 675-foot <br />culvert to a 40-foot long, eight-foot diameter culvert below the permanent access road. The <br />third segment of the permanent stream channel diversion consists of arip-rapped open <br />channel extending 750 feet from the access road to the northwest boundary of the permit <br />area. The Division previously approved the retention of the permanent stream channel <br />diversion prior to Energy Fuels Mining Company taking over the permit in 1987 from the <br />previous operator. <br />The landowner, Mr. A.J. Iuppa, has specifically requested the 675-foot long eight foot <br />diameter culvert to remain after final bond release in a letter to the Division dated July 27, <br />1994. Mr. Iuppa wishes the culvert to remain to allow access to the remaining shop <br />
