i ~ <br />3 <br />Summary of the Review Process <br />Energy Fuels Mining Company submitted an application for phase I bond release for the <br />Raton Creek Mine, permit No. C-82-055, on December 27, 1994. This request was <br />specifically for the backfilling, regrading, and drainage control establishment at the Raton <br />Creek mine site. The Division found the application incomplete on December 29, 1994, due <br />to the absence of the proof of public notification required by Rule 3.02.2(1)d). Upon <br />submittal of this information, and of copies of the notifications required by Rule 3.02.2(a), <br />the Division found Energy Fuels Mining Company's bond release application complete on <br />February 17, 1995. <br />The Raton Creek Mine is located approximately three miles south of Trinidad, Colorado, <br />adjacent to County road 69.3, near the historic town site of Starkville. The mine site is <br />located within portions of: <br />T33S, R63W <br />T33S, R64W <br />T34S, R63W <br />T34S, R63W <br />6th P.M. <br />Section 31- SWya <br />Section 36- except portions of W~/zW~/z <br />Section 6 -all <br />Section 7 - N~/zNE~/a, NEB/aNW~/a <br />Section 1 - E~/zE~/z <br />The description of the area to be considered for phase I bond release consists of: <br />T33S, R63W Section 36- SW~/a of the 6th P.M. <br />The area to be considered comprises 25.3 acres. The mine site is located on the U.S. <br />Geological Survey 7.5 minute quadrangle map entitled "Trinidad East". <br />Energy Fuels has specifically requested the exclusion of two areas from consideration in this <br />bond release application. One of these is a small facilities area consisting of a 100,000 <br />gallon water tank, two concrete pads and a portion of the former preparation plant. The <br />landowner, Mr. A.J. Iuppa, has requested in writing that these structures remain to support <br />his post-mining land use of rangeland. The Division is currently reviewing this request as <br />technical revision No. 17 and is awaiting adequacy responses from Energy Fuels Mining <br />Company prior to issuing a decision. <br />The second area requested for exclusion is the site of the former mine office. At the time <br />of the submittal of the application, this area was being used as a staging area for remaining <br />mining equipment and as yet had not been regraded. Upon removal of any remaining <br />equipment from the former mine office site this location needs to be regraded as per the <br />approved plan. These two excluded areas comprise approximately 2.5 acres. <br />
