Forest Service _ ~ ' <br />South Park Ranger IJiririct <br />Fairplay, CO 80440 <br />Dear Miss Kabele, ' <br />In regard to your inquiry, per the Park County Attorney, Park County does have jurisdiction to <br />impose and enforce its laws, including environmental health regulations, ordinances, land use <br />laws and building codes on federal lands, provided the County's regulations do not conflict with <br />federal or state law and do not substantially impede or prohibit the legal activity whether it is <br />mining, recreational, etc. <br />There are several points that I'd like to address regarding the Walt Rubeck unpatented mining <br />claim at 2310 Matukat Road within the Pike National Forest. <br />During my physical inspection of this mining claim on May 16, 2001,1 found the operation to be <br />well organized, uncluttered with a great deal of attention to detail. <br />PPr Park t:rnmty Land Ilse Regulations, effective December 21. 1996, mining operations within <br />the ConservationJRecreation Zone District require an approved Conditional Use Permit, which <br />can be obtained from the Park County Planning Department. They can be reached at phone <br />number 719-876-4254 or at 1246 County Road 16. <br />Per Park County Land Use Regulations, efFective December 21, 1996, `INobile Home", ie <br />defined, "A mobile home (manufactured home) is not allowed in Park County in any zone as a <br />single family dwelling unless it complies with the National Manufactured Housing Construction <br />and Safety Standards Act of 1974 (42 USC 5401 et seq.), and also complies with Perk County <br />Building Codes for Manufactured Houaing". "Manufactured home" is dellned as ",A <br />manufactured home is partially or entirely manufactured in a factory; is not less than 14 feet in <br />width; is installed on a permanent foundation, i.e., a permanent foundation that meets the <br />county's building codes; has wood, or cosmetically equivalent exterior siding; has a minimum <br />Page 1 oft <br />
