Road 63.9 <br />Trinidad, CO 81082 <br />Re: Vent Shaft Closure -Golden Eagle Mine -Permit No. C-81-013 <br />Deaz Mr. Thompson: <br />This letter is written as afollow-up to our previous letter of July 2, 2003, and subsequent <br />conversations held between the Division of Minerals and Geology (DMG) and <br />representatives for Basin Resources, Ina (Basin), pertaining to the pending vent shaft <br />closure issue at the Golden Eagle Mine. We will also address issues contained in the <br />letter from Davis Graham and Stubbs dated September 16, 2003. Significant potential <br />compliance issues addressed in the DMG letter dated July 2, 2003 remain unresolved at <br />this time, and it is imperative that we move towards resolution in a timely manner. <br />Specific to the September 16, 2003 letter, and subsequent to conversations with Basin <br />representatives, it is our understanding the Mr- Tatum is no longer alleging that Basin <br />may not have access the vent shaft site. Regazdless, all permittees must maintain access <br />to mining and reclamation sites to perform all required duties pursuant to the Coal Rules <br />and Law. As discussed with Basin representatives, if Basin no longer has the legal right <br />to enter the vent shaft site to perform such required duties, then Basin may no longer be <br />in compliance with the Permit No. C-81-013 and the applicable Rules and Law. Please <br />advise the DMG as to Basin's position in this matter. <br />Also, specific to the September 16, 2003 letter, and as discussed with Basin <br />representatives, the bonding for the vent shaft site may or may not be adequate.
