In early May, the Bureau received a copy of
your May 13th field inspection report for Cyprus Orchard Valley Mine, which
noted the stock trail construction activity.
Our Reality Specialist had the opportunity to observe the stock trail area
again last week. The dry summer weather had diminished the revegetation
success, and the new construction ie et ill highly visible.
The stock trail ie on BLH surface, and is completely independent of Cyprus
Orchard Valley Coal Corporation's mining activity, however the trail is in
close proximity to the Weet Portal and indirectly includes the OVWM fill. The
OVWM fill is positioned between the historic, abandoned roadbed and the base
of the stock trail that provides access around the mine portal.
BLM would like to clarify with the Divieon that the maintenance of the stock
trail is the responsibility of the grazing allotment permittee. The fill may
be transvereed by the permittee during spring and fall cattle drives, through
agreement with DML and Cyprus; the fill elope is not included in the
permitee'e maintenance responsibility to BLM.
Ae you realized, stock may be driven across the fill area in the spring or
fall, and may number as many ae 200 head. The permittee plane to use an all-
terrain vehicle to monitor the allotment, and to assist with the trailing of
cattle as well.
Through conversation with N.W. Grosse-Rhode, I am confident he is aware that
the integrity of vegetation and soils along the fill are the responsibility of
Cyprus Orchard Valley Mine and recognizes the importance of minimal impact to
mine project area. BLM has recommended to Karl Koehler, COVCC
environmentalist, that the general fill elope be fenced ae livestock may be in
the area of fill elope during routine utilization of the grazing allotment.
If you have any questions or concerns please call me, or Danna Knox,
environmental protection specialist, at (303) 240-6047.
yours,
/ / ~'
, .
cc: Karl Koehler
~M~
Manager
236069
4190.2 (CO-034)
