Summary <br />The Review Process <br />The Foidel Creek Mine is exclusively an underground coal mining operation. <br />The file number of this permit revision application is PR-07. The permit revision application <br />(PR-07), dated May 10, 2006, was submitted by TCC and received at the Division on May I5, <br />2006. PR-07 was found incomplete on May 17, 2006, and, after receipt of additional information, <br />found complete on May 19, 2006. By PR-07, TCC proposes3, in the Northern Mining District, to <br />extend development and longwall mining into portions of Sections 5 and 6, and to expand <br />development and longwall mining in portions of Sections 4, 7 and 8, of TSN R86W. TCC also <br />proposes, by PR-7, in the Western Mining District, to expand development mining in Section 17, <br />and to extend development mining into portions of Section 18, TSN R86W and portions of <br />Section 13 TSN R87W. <br />TCC published a notice of the application in the Steamboat Pilot and Todav, for four consecutive <br />weeks (June 11, 18, 25 and July 2, 2006. No objections regazding the application were received. <br />A letter expressing three concerns was received from the Colorado Historical Society and <br />transmitted to the applicant on July 3, 2006. These concerns have been addressed in the current <br />proposed version of this revision. By a letter of November 28, 2006, the Colorado Historical <br />Society (State Historical Preservation Officer) cleared the revised application. A letter expressing <br />no comment or objection was received from the Colorado Department of Natural Resources, <br />Division of Water Resources and transmitted to the applicant on June 22, 2006. <br />The applicant/violator system (AVS), maintained by the U.S. Office of Surface Mining (OSM), <br />was queried on August 22, 2006. In regazd to compliance history, the recommendation of the <br />system was to issue this permit revision. However, the information on file was known to be <br />deficient in the system at that time. Afollow-up AVS query on December 8, 2006, at a time <br />when the system had been posted with current information, also resulted in a recommendation to <br />issue this revision. <br />The Division sent a number of adequacy questions to TCC. The responses resolved all adequacy <br />concerns. Therefore, the Division proposes to approve the revision application as amended. <br />Publication of this proposed decision initiates a thirty day public comment period.
