Pastureland and Rangeland aze the predominant land uses in the permit area. Historically, <br />mazginal lands have been planted to small grain crops. The Federal Conservation Reserve <br />Program (CRP) has encouraged the return of these mazginal croplands to rangeland or <br />pastureland. Twentymile Coal Company's post-mining land uses of pastureland and <br />rangeland support the CRP goal and aze in agreement with section 4.16 of the Rules. A <br />discussion of the post-mining land-uses can be found beginning on page 2.05-123, and on <br />page 2.05-181 of Volume I of the PAP. <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />Twentymile Coal Company evaluated the mine plan expansion area for threatened and <br />endangered species. The mining azea is at an elevation above that for habitat defined for Ute <br />lady's tresses orchid. The permit area is below the elevation expected for Boreal toad and <br />lynx. A raptor survey was conducted on azeas projected for subsidence of Middle Creek. No <br />active nesting sites were identified along the proposed affected azea of Middle Creek, and no <br />Bald eagles were observed in the survey area. <br />XIV. Protection of Underground Mining <br />No active surface mining activities are taking place in the immediate vicinity of the Foidel <br />Creek Mine. No specific approvals aze granted under this section. <br />XV. Subsidence Control <br />The applicant has predicted that no material damage will result from subsidence. However, <br />numerous structures exist above previously approved mining azeas. The applicant has <br />presented a subsidence control plan to repair or mitigate damage caused by subsidence for <br />each of the existing structures. Details regarding the subsidence control plan may be found in <br />the approved PAP. A brief summary of the subsidence control measures for each structure <br />follows. <br />County Road No. 33 <br />When daily monitoring revealed that the asphalt road surface had buckled or had been <br />damaged due to subsidence, TCC temporarily repaired the surface using gravel. Once <br />subsidence monitoring indicated that subsidence has ceased, a permanent asphalt overlay or <br />patch was applied to the damaged road section. This method has successfully been employed <br />during the mining of Longwall panels 9R, 8R, 7R, 6R and SR in the Eastern Mining District. <br />Twentymile Coal Company re-paved segments of Routt County Road No. 33 in the fall of <br />1999 that had experienced damage due to subsidence of Longwall Panels SR and 6R. <br />Union Pacific Railroad <br />26 <br />
