PR-03 approved undermining a significant portion of Routt County Road No. 33 in <br />portions of Sections 14, 22, 23, 27, and 28, TSN, R86W. The Division published a <br />notice on October 7, 1993 in the Steamboat Pilot providing the opportunity for a public <br />heazing concerning the undermining of approximately four (4) miles of Routt County <br />Road No. 33. These four miles of road lie within the area affected by longwall panels <br />9R, 8R, 7R (PR-03), 6R and SR (PR-04). There was no public response or concern <br />voiced about undermining of the road. The applicant received all necessary approvals <br />from Routt County to undermine County Road No. 33. Special Use Permit No. 92-233 <br />issued by Routt County approved the undermining and subsidence of County Road No. <br />33 as long as the conditions addressing appropriate road warning signage, monitoring, <br />and repairs are met by Twentymile Coal Company. <br />Approval of PR-04, Apri120, 1998, allowed for continued mining in the Eastern Mining <br />District of Longwall panels 6R through 2R. Only panels 6R and SR had an impact to <br />Routt County Road No. 33. Experience gained during subsidence of panels 9R through <br />7R demonstrated that traffic on County Road No. 33 was not interrupted as a result of <br />the subsidence of the road. Subsidence of Longwall panels 6R and SR did not interrupt <br />traffic on Routt County Road No. 33. <br />Approval of PR-O5, May 28, 2000, allowed longwall panel 12 Right to undermine a <br />Twentymile sandstone outcrop in Section 14, TSN, R86W. Prior to approval TCC <br />demonstrated there was a very slight potential for rock from this outcrop to reach Routt <br />County Road 33 as a result of the undermining. TCC committed to scaling loose rock on <br />the slope prior to undermining, using concrete barriers along the north side of Routt <br />County Road 33 (as necessary), and draping chain link mesh over the outcrop. <br />Affected areas approved in PR-06, May 21, 2004, are more than one-quarter mile from <br />public roads. <br />Affected areas proposed in PR-07 are more than a mile from public roads. <br />h) Three hundred feet of an occupied dwelling unless a written waiver from the owner has <br />been provided. TCC successfully complied with Stipulation No. 36 for the Southwest <br />Mining District on Mazch 25, 1994 for the mobile home owned by Mc Robert Perry. <br />Three dwellings were undermined in the Eastern Mining District (Longwall Panels 6R- <br />2R) during 1999. One had been occupied year round (Ashley dwelling), one was vacant <br />and owned by Twentymile Coal Company, and the third was occupied only during <br />portions of the year. Twentymile Coal Company has a subsidence agreement with Mr. <br />Kenneth Ashley regazding his dwellings. [2.07.6(2)(d)(v)]. <br />The full-time (Ashley) residents were moved by Twentymile Coal Company to <br />alternative accommodations prior to subsidence of the house. Twentymile Coal <br />Company took precautions with the home by bracing floor joists and door frames prior <br />to undermining. The house was located near the center of Longwall panel 5 Right. After <br />subsidence occuned, Twentymile Coal Company and the Ashley's agreed upon <br />18 <br />
