Summary <br />The Review Process <br />Submittal of Application <br />Permit No. C-80-001 was issued on November 16, 1981, and has been renewed every five <br />years since then. <br />For the current renewal, the Division notified P&M by letter on February 1, 2006 that its <br />permit for the Edna Mine would expire on November 16, 2006. The letter explained that <br />that, for operations to continue beyond that date, Rule 2.08.5(3)(f) requires an application <br />for renewal to be received on or before May 20, 2006. P&M submitted a renewal <br />application on May 12, 2006, and it was found complete on May 19, 2006. <br />P&M published a notice of the application in the Steamboat Pilot and Today for four <br />consecutive weeks: June 4, 11, 18, and 24, 2006. <br />Comments and Objections <br />No objections regarding the application were received. <br />Applicant Violator System Queries <br />The applicant violator system (AVS) was queried on August 22, 2006. In regard to <br />compliance history, the recommendation of the system was to issue this permit renewal. <br />A follow-up AVS query on December 11, 2006 and another on January 8, 2007, also <br />resulted in recommendations to issue this renewal. <br />Division Adequacy Review and Timeframes <br />The Division identified three adequacy questions of P&M regarding the application for <br />renewal. These items were an update of the Identification of Interests (Rule 2.03.4), <br />establishment of a point of compliance for groundwater monitoring [Rule 4.05.13(1)(b)], <br />and updating consideration of threatened and endangered species [Rule 4.18(2)]. P&M <br />resolved the adequacy items. The Division proposes to approve the renewal application <br />with a stipulation, as previously stated. <br />Publication of this proposed decision initiates athirty-day public comment period. <br />Provided there are no objections to the decision, it becomes final at the close of the <br />comment period. <br />C-1980-001 Permit Renewal 5 Findings Page 6 oF33 Pages <br />
