This letter is a <br />modification of my previous letter dated October 10, 1984. <br />Appropriate comments are listed beside each stipulation below. <br />These comments will be incorporated in the final permit document <br />as appropriate. <br />Stip 1: The applicant has installed a staff gauge at sediment. <br />pond 4. The staff gauge has been marked to indicate <br />an elevation of 7,512 feet. At this level, the sediment <br />volume will be 1.75 acre feet. The applicant will clean <br />out the sediment when the sediment level reaches the <br />7,512 ft. level. <br />Stip 2: The applicant will register the pit 5/6 sediment pond <br />with the Colorado Department of Water Resources. This <br />form will he submitted to CtdLRD prior to final bond <br />release. <br />Stip 3: The applicant will monitor surface water sites SW1, <br />SId2, SW4, SW7, and SW8 on a monthly basis during <br />the active Wining phase. ilonthly herein means those <br />months when water is present and when the anplicant <br />can physically reach the sites and collect samples. <br />If weather conditions, and/or adverse site conditions <br />prevent access to those sites, the applicant will not <br />sample. At the end of the active mining phase, the <br />applicant and the Division will agree to a post-mining <br />frequency that may or may not be less frequent, depend- <br />ing on the outcome of the monitoring results obtained <br />
