Dept. of Neturel Resources Mr. Dan Mathews Reclamation Specialist Colorado :dined Land Reclaimation Division 1313 Sherman Street, Suite 305 Denver, Colorado 80203 RE: THE ROCKCASTLE COPIPANY GRASSY GAP COAL idINE RESPONSES TO PP.OPOSED STIPULATIONS Dear Dan: The purpose of this letter is to document what the Roclccastle Company (the applicant) has done or intends to do with regard to each of the proposed stiputlations. This letter is a modification of my previous letter dated October 10, 1984. Appropriate comments are listed beside each stipulation below. These comments will be incorporated in the final permit document as appropriate. Stip 1: The applicant has installed a staff gauge at sediment. pond 4. The staff gauge has been marked to indicate an elevation of 7,512 feet. At this level, the sediment volume will be 1.75 acre feet. The applicant will clean out the sediment when the sediment level reaches the 7,512 ft. level. Stip 2: The applicant will register the pit 5/6 sediment pond with the Colorado Department of Water Resources. This form will he submitted to CtdLRD prior to final bond release. Stip 3: The applicant will monitor surface water sites SW1, SId2, SW4, SW7, and SW8 on a monthly basis during the active Wining phase. ilonthly herein means those months when water is present and when the anplicant can physically reach the sites and collect samples. If weather conditions, and/or adverse site conditions prevent access to those sites, the applicant will not sample. At the end of the active mining phase, the applicant and the Division will agree to a post-mining frequency that may or may not be less frequent, depend- ing on the outcome of the monitoring results obtained
