The Colorado Land Reclamation Act for the Extraction of Construe ion Materials, <br />34-32.5-101 et sec ., C.R.S. (the Act), and the Construction Mater al Rules and <br />Regulations of the Colorado Mined Land Reclamation Board Ithe R les), require that <br />an operator conduct grading and drainage control necessary to con rot erosion and <br />siltation of the affected lands, to protect areas outside the affecte land from slides <br />and other damage, to minimize disturbances to the prevailing hydr logic balance of <br />the affected land and of the surrounding area, and generally to enh nee the <br />stability of reclaimed areas. DMG will require that the revised reel mation plan <br />demonstrate compliance with the performance requirements of the Act and Rules. <br />Please find enclosed, copy of DMG's memo from staff member All n Sorenson to <br />Wallace Erickson, dated October 6, 2000, addressing the stability emonstration <br />required for the Surface Rock Pit operation. <br />2. DMG's authority is limited to enforcement of the Act and Rules. H wever, as <br />noted under item 1 above, the Act and Rules require that operation be conducted <br />in a manner which protect areas outside the affected land from slid sand other <br />damage. Pursuant to the Act and Rules, DMG can require that gra ing and <br />drainage control for affected lands not adversely impact the stabili of the adjacent <br />Hwy 141. <br />3. The final configuration of the highwall and final grade of the affect d lands <br />between the highwall and the southern perimeter of Area "A" will a addressed in <br />the proposed revision to the reclamation plan.
