_17_ <br />The ground water sections, found on pages 30-34 and 44-47-1a of the <br />application for the Bear No. ] and No. 2 Mines, and pages 2.04-29 - 2.04-32, <br />2.05-55, and 4.05-8 through 4.05-11 of the Bear No. 3 Mine application, have <br />been reviewed by the Division for compliance. The permit revision for the <br />additional 264 acres includes areas in the same ground-water-regime as the <br />original permit, and also the Mt. Gunnison No. 1 application. <br />In order to assess the quantity, quality, and source of any future mine <br />inflows in the Bear No. 3 Mine, and in order to identify the actual impacts of <br />the mine workings on the hydrologic balance within the mine plan and adjacent <br />areas, the Division is requiring the following stipulation to the permit. <br />Currently, the Bear No. 3 Mine is not experiencing any inflows and is in <br />compliance with the following stipulation: <br />Stipulation No. 1 <br />THE APPLICANT SHALL CONTINUE TO SUBMIT TO THE DIVISION AN ANNUAL REPORT <br />OF INFLOWS, DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS <br />REPORT IS TO INCLUDE A WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF <br />INFLOWS; A TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE <br />(i.e., FAULT, FRACTURES, ETC.) QUANTITY, DURATION, AND QUALITY <br />(i.e., pH, ELECTRO-CONDUCTIVITY AND TEMPERATURE) OF ALL INFLOWS; A TABLE <br />CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE <br />MINE AND IMPORTED FOR USE WITHIN THE MINE. <br />A number of other questions raised by the Division regarding protection of the <br />hydrologic balance and water rights issues associated with the Bear No. 1 and <br />No. 2 operation are no longer pertinent to the current situation since mining <br />ceased at the No. 1 and No. 2 Mines in June of 1982, and reclamation is to be <br />essentially completed by fall of 1985. <br />The following concern was raised by the Division in the adequacy letter of <br />January 18, 1982, and relates specifically to the Bear No. 3 application. <br />Previous alluvial monitoring data collected by Bear Coal Company at the <br />Bear No. 1 surface facilities area, as we71 as hydrology data collected by <br />WECC for the Mt. Gunnison No. 1 Mine has been incorporated into the <br />application and reviewed by the Division. The Division requested additional <br />data in order to further define the alluvial aquifer and monitor potential <br />impacts in the vicinity of the proposed Bear No. 3 facilities area. The <br />applicant installed three monitoring wells and has conducted a pump test, <br />submitted water quality data with water levels, and provided a map indicating <br />the horizontal extent of the aquifer and water table levels across the permit <br />area (see "Alluvial Ground Water Hydrology of the North Fork of the <br />Gunnison River - Bear No. 3 Operation"). <br />The applicant has collected four years of complete monitoring data from the <br />Bear No. 3 alluvial wells in order to monitor the effects of mining on the <br />hydrologic balance. The Division finds Bear Coal Company in conformance with <br />Rules 2.05.6(3)(b)(iii) and 4.05.13(1), and to specify the appropriate <br />monitoring requirements, the following stipulation is included. <br />
