In the applicant's response to <br />that letter, received by the Division on February 28, 1982, Bear Coai Company <br />committed to completely reclaim all surface facilities at the Bear No. 1 and <br />No. 2 Mines. However, subsequently, WECC has revised their permit to <br />incorporate the major portion of the old Bear No. 1 site, with the exception <br />of the backfilled portal. West Elk Coal Company (WECC) has assumed the <br />reclamation responsibility for those areas as detailed in WECC's technical <br />revision application of 1984. <br />The applicant has committed to returning land to the pre-mining land uses of <br />wildlife habitat for Bear No. 1 and 2 and, in the case of the No. 3 portal anc <br />facilities area, to return the land to undeveloped land supporting limited <br />wildlife and limited residential use. This land use is consistent and <br />compatible with Gunnison County zoning. The surface landowners, ARCO, U.S. <br />Steel, Anchor Coal Company, Grand Mesa Properties, and the Highway Department, <br />have provided written approval of the post-mining land use. <br />Pursuant to Rule 2.07.6(2)(1), the post-mining land uses of wildlife habitat <br />and undeveloped land have been approved by the Division. These uses meet the <br />requirements of Rule 4.16. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4 <br />Pursuant to Rule 2.07.6(2)(e), and on the basis of evidence submitted by the <br />applicant, the Division finds that the proposed mining operation will not <br />adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. No previously undisturbed areas will be <br />disturbed by Bear Coal Company's proposed operations during the permit term. <br />The site of the proposed Bear No. 3 facilities area has been previously <br />disturbed by mining, beginning in the 1930's. <br />IV. Geology - Rules 2.04.5 and 2.04.6(2) <br />For a description of the geology for the mine area, please see the Regional <br />Geology and Ground Water Hydrology portion of Section IX, Probable Hydrologic <br />Consequences and Cumulative Impact Assessment of this document. <br />The geology sections of the permit application, found in Sections 2.04.5 and <br />2.04.6 of the Bear No. 1 and No. 2 portion of the application and in the same <br />sections of the Bear No. 3 portion, have been reviewed by the Division for <br />compliance. The applicant has supplied revised geologic maps delineating <br />faults, folds and landslides. <br />Drill hole logs requested by the Division were provided in Maps 2.04.6(2)(a)-7 <br />and 2.04.6(2)(a)-8 of the Bear No. 1 and No. 2 application. Electric logs <br />were provided for two holes in Exhibit 8 of the Bear No. 3 application. The <br />applicant stated that the depth where water was first encountered in the holes <br />drilled by ARCO above the workings of the Bear No. 1 and No. 2 was not <br />available, but that during hydrologic testing, no large volumes of water were <br />encountered in sandstone zones above the F Seam.
