Ten Notices of Violation and one Imminent Harm Cessation <br />Order have been issued to Basin Resources, Inc., within the last <br />twelve months. These Notices of Violation were issued as the result <br />of inspections conducted on March 23, 1993, April 27, 1993, and <br />August 13, 1993. <br />All ten Notices of Violation and the one Cessation Order have been <br />upheld in an Assessment Conference, with the permittee paying a total <br />of $14,450.00 in civil penalties. All appeal periods have passed, <br />with no appeals having been filed by the permittee. <br />Six of the ten violations were issued for violations of the <br />Performance Standards related to the protection of the hydrologic <br />balance, as was the one Cessation Order. These six Notices of <br />Violations and one Cessation Order are: <br />1. CO-93-012 - Issued for the permittee's failure to minimize water <br />pollution while conducting mining operations by allowing the <br />discharge of coal fines through the Pond 3 outlet (3/23/93 <br />inspection). <br />2. C-93-014 - Issued for the permittee's failure to submit for <br />approval, prior to installation, designs for eleven culverts and <br />five topsoil pile sediment control measures (3/23/93 inspection). <br />3. C-93-015 - Issued for the permittee's failure to submit for <br />approval, prior to installation, the designs for three sediment <br />ponds and the demonstrations for three small area exemptions, and <br />failure to possess certification for six sediment ponds and one <br />haul road (3/23/93 inspection). <br />
