II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br />Information on land use can be found in Appendix A of Volume I of the original <br />permit application. <br />The primary land use at the Canadian Strip Mine site was wildlife habitat and <br />rangeland for cattle grazing prior to mining operations. The reclamation plan <br />proposed by Wyoming Fuel Company is to return the land to equal or better <br />utility for these same uses. Post-mining land use will be wildlife habitat <br />and rangeland. Pursuant to Rule 2.07,6(2)(11, the Division finds that the <br />proposed post-mining land use of the permit area meets the requirements of <br />Rule 4.16. <br />The operation is in compliance with the requirements of this section. <br />III, Cultural and Historic Resources - Rules 2,04.4 and 2.05.6(4) <br />Information on cultural and historic resources can be found in Section 2.04.4 <br />and Appendix B of Volume I of the original permit application. <br />Several cultural resource inventories have been conducted on lands included <br />within the Canadian Strip Mine permit area. A study by Pioneer Archaeological <br />Consultants identified previously unknown sites as well as noting the presence <br />of sites recorded by a previous survey. Two sites were located in the <br />vicinity of an existing haul road (BLM right-of-way). Both of these sites <br />have been previously protected by stipulated avoidance. <br />The second survey, by Gordon and Kranzush, Inc, in 1980 and 1981, identified <br />new sites, however, none of the newly recorded finds were recommended as <br />eligible for nomination to the National Register of Historic Places. <br />Stipulation No. 1 of the original permit required that no surface disturbance <br />take place within 100 feet of two sites until their eligibility had been <br />determined by the regulatory authorities. One of the sites, 5 JA407, has <br />since been determined ineligible by the BLM. The other site, with <br />undetermined status, occurs in the area which will not be developed. As no <br />surface disturbance activities are planned for this area, protection of the <br />site is no longer an issue regardless of eligibility. The Division finds that <br />the proposed operations will not adversely affect any place listed on the <br />National Register of Historic Places or eligible for such designation. <br />The operation is in compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6 <br />The applicant has provided both a general description of the regional geology <br />and a detailed analysis of the physical and chemical characteristics of all <br />strata disturbed at the site in Section 2,04.7 and Appendix C of the original <br />permit application. <br />
