Introduction
<br />This document is the Permit Revision No. 3 proposed decision package prepazed by the
<br />Colorado Division of Minerals and Geology (Division) for the Bowie No. 2 Mine. Permit
<br />Revision No. 3 proposes to construct a downhill conveyor, a coal stockpile and coal haul truck
<br />loading system, relocate a sedimentation pond and increase coal production to 5 million tons per
<br />year.. This document is a modified version of the findings document for Permit Revision No. 2.
<br />This document includes: 1) the proposed decision to Approve With One Stipulation the permit
<br />revision application; 2) a summary which includes a history of the review of the permit revision
<br />application, a description of the environment affected by the operation and a description of the
<br />mining and reclamation plan; and 3) the written findings of compliance the Division has made as
<br />required by the Colorado Surface Coal Mining Reclamation Act. Detailed information
<br />concerning the findings of compliance can be found in the Regulations of the Colorado Mined
<br />Land Reclamation Board for Coal Mining.
<br />The Division has received an application for a permit revision to revise surface coal mining
<br />operations at the Bowie No. 2 Mine. The application was submitted by Bowie Resources Limited
<br />(BRL). The mine is operated by Bowie Resources Limited.
<br />The mine permit area is located on Federal and Private lands within Delta County, Colorado. All
<br />of the coal to be mined is privately owned, as are all the surface lands to be disturbed by mining.
<br />The federal lands located within the permit area will not be disturbed by surface development
<br />activities. These federal lands are, however, within the areas of land which may be subjected to
<br />subsidence impacts. In accordance with direction provided by the Office of Surface Mining
<br />(OSM), the Division and the OSM consider the Bowie No. 2 Mine to be a private mine, for the
<br />purposes of permit and inspection regulation.
<br />The Bowie Mine No. 2 is located about five (5) miles northeast of Paonia, Colorado, adjacent to
<br />State Highway 133 and near the old Bowie townsite. The permit area includes 2406 acres, of
<br />which 2058 are privately owned and 348 acres are federally owned. Approval of Permit Revision
<br />No. 3 would add 6.0 acres of privately owned land to the permit azea acreage. The legal
<br />description of the lands included within the permit area is Township 13 South, Range 91 West,
