"Suggested Practices for Raptor Protection on Power Lines: The State of the Art in 1996", and <br />planned to incorporate [see Rule 4.18(1)] the program in a technical revision (TR) to the PAP (1 <br />August 2002 Division inspection report). The TR application has not been submitted. However, <br />Colowyo reports (letter of December 17, 2004) that some of the retrofit work (27 of 75 work <br />items determined to be required) as accomplished. Construction of a new power line neaz the <br />East Pit was found to be, by exception, in compliance with the PAP (the power line was of such <br />a design that raptor protection devices were not required) during a Division Inspection of 3 June <br />2004. The status of remaining retrofit work was a subject of the 27 September 2004 Coal <br />Complete Division Inspection (nearing the close of the 2004 construction season). Work <br />scheduled for 2004 was reported as not having been accomplished, and was so identified in <br />subsequent inspection reports. <br />Please submit the revised retrofit work schedule for consideration in the form of an application <br />for a revision to Permit C-1981-019. Due to time constraints, the Division will accept such an <br />application for a Minor Revision. Please incorporate changes (perhaps the Colowyo 2002 <br />program as an exhibit) as appropriate to the PAP to recognize the improvements proposed to be <br />adopted over cuaent criteria of the PAP, and to insure retrofit work accomplished is recognized <br />as a current permitted practice [note that Rule 4.18(4) addresses power lines and other <br />transmission facilities]. Please include a schedule (cross-reference), or format the revision, so <br />that any power pole or transmission facility provided for or owned by Colowyo within the permit <br />boundary can be readily correlated to an approved design (or annotate that such pole or facility <br />has been permanently decommissioned) and location (reference to a map). Please increase the <br />detail of the revised schedule to at least a quarterly (in-lieu-of annual) level. Please submit the <br />revision application to the Division by the end of January 2005 so that the improved designs (as <br />appropriate) of the program and work schedule aze included in the approved PAP prior to the <br />proposed 2005 and 2006 retrofit work. <br />Please call me if you have any questions. <br />Yours truly, <br />Byr n G.
