Long <br />Boulder, CO 80303 Division Director <br />Subject: Questions regarding increasing the size of [he pond upon final reclamation, and possible use of [he final <br />pit as water storage for Permit No. M-1988-108 TXI -Boulder Pierre Shale Mine <br />Dear Mr. Feiner: <br />I am writing I.o address questions raised in our meeting of January 23, 2002 regarding increasing [he size of the pond in <br />[he bottom of the final pi[ from 10 acres to 20 or 30 acres. This action would be covered as a Technical Revision, which <br />is defined in [he Rules as "...a change in the permit or an application, which does no[ have more than a minor effect upon <br />the approved or proposed Reclamation Plan." The operator should contact the Office of the Stale Engineer to determine <br />if additional augmentation water would be required [o accomplish [his goal. <br />The process of developing and applying for utilization of the final pit as a municipal water storage facility would be <br />covered as an Amendment. Amendment is defined in the Rules as "...a change in the permit or an application which <br />increases the acreage of the affected land, or which has a significant effect on the approved or proposed Reclamation <br />Plan." The firs[ step in this process would be to contact either Mr. Bill McIntyre or Mr. Jeff Detheridge in the Office of <br />the State Engineer. Mr. Mclntyre's direct phone number is 303-866-3581 ext. 242. The next step would be [o contact <br />municipalities who may have water rights on Coal Creek. <br />I have several binders of information regarding Amendment 1 to allow disposal of fly ash in the pit. This amendment <br />was withdraH~n by TXI, and the information is available [o you.
