<br />i <br /> <br />Mr. Randy Acre -2- February 8, 1994 <br />Energy Fuels Coal, Inc. <br />have further questions or reservations regarding the right to enter question, please contact <br />Assistant Attorney General Steven Brown at 303-866-3117. <br />Energy Fuels has requested that liability waivers be provided for the reclamation <br />contractor, Divisi~~n and Energy Fuels personnel. Such waivers are not necessary for two <br />reasons. The Division has assumed performance standard responsibility for the light use <br />road during construction as discussed above. Secondly, the contractor is required to <br />provide liability insurance and workmans compensation insurance as conditions of being <br />awarded the reclaimation contract per Division of Contracting requirements. These <br />contingencies will cover potential liabilities associated with the reclamation project. <br />As a point of clarification, I would like to point out that the Division issued an amendment <br />to the reclamation project bid document on January 12, 1994. This amendment clarified <br />that the Chen's Hlill road will not be eliminated as stated in the original bid document.
