On 8/13/96, I received a phone call from Geof Schlittgen of Horizon Reality. Mr.
Schlittgen requested to come to DMG Durango office in the afternoon of 8/13/96, to
review and copy maps of the permit area for the Thomas Pit, M-76-020. I informed Mr.
Schlittgen that he was welcome to review public files and that I would be available
through out the afternoon of 8/13/96. During the phone conversation with Mr.
Schlittgen, I stated that on 8/12/96, I had received phone call from Mike Long, DMG
Director, regarding a written complaint from Mr. Schlittgen to Representative Jim Dyer.
Subject of the written complaint was adverse impact to the Animas River channel and an
irrigation ditch, allegedly resulting from operations conducted at the Thomas Pit. I
informed Mr. Schlittgen that DMG would respond to the written complaint vvith an
inspection of the Thomas Pit. I requested that Mr. Schlittgen bring a copy of his letter
with him, for DMG review and to ensure that DMG inspection address his specific
concerns.
During the afternoon of 8/13/96, Mr. Schlittgen and Rick Mayo of Vega Verde Ranch,
arrived at the DMG Durango office. I showed Mr. Schlittgen and Mr. Mayo the maps of
the Thomas Pit permit area. Mr. Schlittgen and Mr. Mayo indicated that the: maps
available in DMG public files were similar to the maps in their files and as such, neither
individuals requested copies of DMG file maps. Mr. Schlittgen and Mr. Mayo requested
copy of DMG denial letter for an Amendment submitted in 1981, to the Thomas Pit
permit. DMG denial letter for the 1981 Amendment was not located in DMG paper files.
I informed Mr. Schlittgen and Mr. Mayo that copy of the DMG review and decision of the
1981 Amendment were contained within the microfiche files and that I would review the
microfiche files and provide a copy to them upon review of the microfiche files.
Mr. Schlittgen and Mr. Mayo stated that landowners along the east bank of the Animas
River and adjacent to the Thomas Pit and landowner located downstream of the Thomas
Pit were concerned that operations at the Thomas Pit had been conducted in a manner
which had resulted in adverse impact to the Wallace Ditch, an irrigation ditch located on
the east bank of the Animas River, and to the channel of the Animas River. Mr.
Schlittgen provided the following documents for DMG to copy and include within the
public file:
