NO DISTURBANCE IS APPROVED FOR THE LOWER WILSON AREA <br />WITH THE APPROVAL OF PERMIT REVISION 02. <br />STIPULATION 8 <br />NO LATER THAN 15 MARCH 2008 THE COLOWYO COAL COMPANY SHALL SUBMIT A <br />TECHNICAL REVISION TO THE DIVISION CONTAINING A COMPREHENSIVE <br />RECLAMATION PLAN FOR THE EAST PIT, WEST PIT, SECTION 16 PIT, SOUTH TAYLOR <br />PIT, FACILITIES AREA, GOSSARD LOADOUT AND ALL REMAINING DISTURBANCES AT <br />THE COLOWYO MINE. THE REVISION WILL ELIMINATE OUTDATED METHODS OF <br />RECLAMATION THAT ARE CURRENTLY USED AT THE COLOWYO MINE. FURTHER, <br />THE REVISION WILL ADDRESS DIVISION CONCERNS REGARDING REVEGETATION, <br />SOILS HANDLING AND SPECIES DIVERSITY SUCCESS STANDARDS, ETC. TO MEET THE <br />CURRENT POST-MINING LAND-USE. CONSULTATION WITH THE DIVISION, THE <br />COLORADO DIVISION OF WILDLIFE, THE BUREAU OF LAND MANAGEMENT AND <br />OTHER APPROPRIATE AGENCIES WILL BE NECESSARY. <br />B. Contemporaneous Reclamation <br />Section 4.13 of the Permit contains information on contemporaneous reclamation for Colowyo's <br />multi-seam operations, with additional information found in Sections 2.05.4 and 4.14 (Volume 1 for <br />the East Pit, West Pit, Section 16 Pit, Facilities Area and Gossard Loadout and Volume 12 for the <br />South Taylor Pit). Backfilling and grading cannot begin with multi-seam operations until the lowest <br />seams are mined. Therefore, backfilling and grading cannot be completed within 180 days of the <br />removal of the uppermost coal seams. In addition, the number of spoil ridges may exceed four at <br />multi-seam operations. <br />In addition, variances from contemporaneous reclamation have been granted to accommodate high- <br />wall mining operations. <br />Based on the nature of the South Taylor Pit, which is amulti-seam operation, backfilling and grading <br />cannot be completed within 180 days of the removal of the uppermost coal seam. The Division has <br />granted Colowyo a variance for contemporaneous reclamation for the South Taylor Pit. <br />Additionally, given the constraints of the pit, the number of coal seams and sub-seams being mined <br />and the topography, very little reclamation will be completed in the current permit term (ending 5 <br />November 2007) or the following permit term (ending 5 November 2012). All of the overburden <br />and interburden material from the upper seams will be mined using a truck/shovel operation and will <br />be stockpiled in two temporary out-of--pit piles (TS West and TS East). During the current and <br />following permit terms approximately 44 million cubic yards of material will be stockpiled at these <br />two locations. The lower coal seams will be mined using a dragline. The interburden material that is <br />back-cast with the dragline will remain in an ungraded state until the stockpiled spoil is returned to <br />the pit.
