V. Sealing of Drilled Holes and Underground Openings -Rule 4.07 <br />The Permit is found to be in compliance with Rule 4.07. Each exploration hole, other bore hole or <br />other exposed opening constructed or encountered during mining will be cased, sealed or otherwise <br />managed (some holes are mined through) according to the requirements of 4.07. Details are found <br />beginning on page 2.05-58 of the Permit. Monitoring wells will be fitted with temporary caps. Holes <br />dug to aquifers will be sealed with cement or other suitable sealant to within ten feet of the surface. <br />VI. Use of Explosives -Rule 4.08 <br />The Permit is found to be in compliance with the requirements of Rule 4.08. The blasting plan is <br />found in Section 2.05 and in Section 4.08 of the Permit. The Permit provides typical blasting patterns <br />(see 2.05-28 and Maps 26 and 27 of the Permit). Blasting patterns specific to each blast are recorded <br />on the individual blasting records (Rule 4.08.5). <br />A description of the explosives storage facility is presented in Exhibit 16 of the Permit. Durnham <br />Ranch dwellings aze located within one-half mile of the permit area. Apre-blast survey was <br />conducted on January 10 and 11, 1991 (date of report 19 February 1991). <br />There are several additional structures that required apre-blast survey for Permit Revision 02. These <br />structures are the Tri-State Generation and Transmission Association 345 kV power lines aze within <br />1,000 feet of the box-cut for the South Taylor Pit. Eight poles over a distance of 1 3/o miles were <br />surveyed. A residence, the Paul Routsen residence at 6647 and 7072 Moffat County Road 51, was <br />also surveyed. This residence is approximately 5,000 feet from the South Taylor Pit. These surveys <br />were conducted on 9 August and are contained in Exhibit 14 of Volume 13 of the PAP. <br />Colowyo has not changed any of its blasting plans or blasting records with Permit Revision 02. <br />VII. Disposal of Excess Spoil -Rule 4.09 <br />The Permit is found to be in compliance with Rule 4.09. Information on excess spoil waste can be <br />found in Sections 2.05 and 4.09 of the Permit. <br />Colowyo Mine currently has three approved excess spoil fills: Streeter, West Pit, and Section 16. <br />Overburden material from the initial box cut for beginning the East Pit was placed in the Streeter <br />valley fill. Now complete, Streeter Fill contains approximately 54 million cubic yazds of excess spoil <br />fill. Capacity of the West Pit fill is 16.5 million cubic yards and capacity of the Section 16 fill is 1.5 <br />million cubic yards. <br />Specific information on the Streeter Fill can be found in Exhibit 12 of the Permit and in Section B, <br />Item V of the original findings document. Specific information on the West Pit and Section 16 fills is <br />presented in Exhibit 19 of the Permit and in the files for revision PR-Ol. The fills meet the regulatory <br />definition of valley fills and therefore must meet the regulatory requirements of Rules 4.09.1 and <br />Proposed Decision and Findings of Compliance 4 May 2007 <br />Permit Revision 02 Page 46 <br />
