This Haul Road B is an asphalt paved road from State Highway 13 to the main haul road. A Mine <br />administrative office building is located along this Haul Road B. Both haul roads meet all design and <br />construction requirements of the haul road regulations. The reclamation plan calls for the removal of <br />the pavement, reduction of the road width to 12 feet, reduction of side slopes to 4:1 and revegetation <br />of the sideslopes for Haul Road B [Permit, page 2.05-61; Rule 4.03.1(1)(f)(ii)].Hau1 Road A is to be <br />removed and reclaimed. No new haul roads aze proposed with the submittal and approval of Permit <br />Revision 02. <br />B. Access Road -Rule 4.03.2. The new road from Colorado Highway 13 to the Section 21 Pond and <br />the Section 28 Pond is designated as an access road. This road has been designed to and will be <br />constructed in accordance with Rule 4.03.2. <br />C. Light Use Roads -Rule 4.03.3. Light use roads, some of which were pre-mining trails, are used <br />infrequently to monitor sedimentation ponds or other facilities, These roads meet the design <br />requirements of the Rules. Some light use roads will be retained following reclamation as "ranch <br />roads" to approximate roads that were in the azea before mining (Permit, page 2.05-61). <br />D. In-Pit Haul Roads, As presented in Rule 1.04(111), the definition of "road" does not include <br />roadways within the immediate mining pit area. This includes the haul roads in the East and West <br />Pits and the haul roads that are being constructed with the approval of Permit Revision 02 in the <br />Section 16 Pit and the South Taylor Pit, <br />II. Support Facilities -Rule 4.04 <br />The Permit is found to be in compliance with the requirements of Rule 4.04. Information on mine <br />support facilities is found in Section 4.04 of the Permit. The Division finds that support facilities aze <br />designed, constructed, maintained, and their planned demolition and (area) reclamation aze <br />sufficient, to: prevent damage to fish, wildlife, and related environmental damages and prevent <br />additional contributions of suspended solids to streamflow or runoff outside the permit area [Rule <br />4.04(1)]; control and minimize diminution or degradation of water quality and quantity [Rule <br />4.04(2)]; control and minimize erosion and siltation [Rule 4.04(3)]; control and minimize air <br />pollution [Rule 4.04(4)]; prevent damage to public or private property [Rule 4.04(5)]; and minimize <br />damage, destruction, or disruption of services provided by oil, gas, water wells; oil, gas, and coal <br />slurry pipelines; railroads, electric and telephone lines; water and sewage lines which pass over, <br />under, or through the permit area, unless otherwise approved by the owner of those facilities and the <br />Division [Rule 4.04(6)]. <br />No new support facilities were proposed with the submittal and approval of Permit Revision 02. <br />III. Hydrologic Balance -Rule 4.05 <br />The Permit is found to be, with an approved partial exception [see paragraph G(2)(K) below], in <br />Proposed Decision and Findings of Compliance 4 May 2007 <br />Permit Revision 02 Page 31 <br />
