<br />•~ This matter relates to the potential for subsidence of the under- <br />ground workings to affect structures on the surface, such as <br />county roads. The mine was designed to prevent any subsidence by <br />leaving substantial support pillars in place in the underground <br />workings, among other measures. That design was approved by the <br />Division in the original Permit and carried out in the mining <br />operations. No subsidence effects have occurred on the surface <br />lands above any part of the mine in the more than four years <br />since mining ceased. This makes it clear that the design worked <br />as intended. But, if an,y future subsidence should adversely af- <br />fect the county roads, Grand Mesa has the responsibility to rec- <br />tify the situation under the Division's Regulation 4.20.3 (2) (s) <br />which reads as follows: <br />(2) Each person who conducts underground mining activities <br />which result in subsidence that causes material damage or <br />reduces the value or reasonably foreseeable use of surface <br />lands shall, with respect to each surface area affected by <br />subsidence: <br />(al Restore, rehabilitate, or remove and replace each <br />damaged structure, feature or value, promptly after damage <br />is suffered, to the condition it would be as if no sub- <br />sidence had occurred and reasonably foreseeable uses it was <br />capable of supporting before subsidence. <br />The County's approval will not diminish Grand Mesa's obligations <br />under this regulation in any way. <br />I would be happy to answer any questions you or your staff may <br />have about this matter and to discuss it further with the ap- <br />propriate people.
