Demonstration that Surface Coal Mining and Reclamation 0 erations can be Feasibly Accomplished - Rule 2.07.6 2 b Based on information contained in the permit application, the Division finds that surface coal mining and reclamation can be feasibly accomplished at the La Plata No. 1 Mine. Information demonstrating the feasibility of the mining and reclamation plan can be found in Sections 2,04 and 2.05 of the permit application. The applicant is in compliance with the requirements of this section. XXVII. Compatibility with Anticipated Adjacent Operations - In addition to the proposed La Plata No. 1 Mine, there are two other coal ~~ mining operations located in Hay Gulch: National King Coal, Inc. (Permit C-81-035) which is permitted and active; and Blue Flame Coal Mine Company (File C-81-053) which has not obtained an approved permit and remains inactive. These two operations, however, are not located adjacent to the proposed La Plata No. 1 Mine. Therefore, the proposed La Plata No. 1 Mine is not inconsistent with any existing operation nor is this proposed operation inconsistent with any anticipated operations in adjacent lands or any land use restrictions. The applicant is in compliance with the requirements of this section. XXVIII. Reclamation Fees Required by 30CFR, Chapter VII, Sub-Chapter R Rule 2.07.6(2)(0) La Plata Coal Corporation is a new corporation that has not previously operated a coal mine. Therefore, no orphan land fees have previously been paid nor been required to be paid. One of the entities with a controlling interest in La Plata Coal Corporation, Mr. Frank Podpechan, does have a number of coal permits issued in the State of Oklahoma. According to telephone conversations with the Office of Surface Mining Reclamation and Enforcement representatives in Washington, D. C., a]1 required orphan land fees have been paid.
