Simpson, P.E. <br />State Engineer <br />RE: East Rigden Pit Substitute Water Supply Plan, M-79-097 <br />Section 28, T7N, R68W, 6th P.M. <br />Water Division 1, Water District 3, Larimer County <br />Dear Mr. Raines: <br />We have received your letter of August 26, 2004, requesting renewal of the above referenced <br />substitute water supply plan to cover depletions caused by an existing gravel mining operation. The <br />required fee of $217 for the renewal of this substitute water supply plan has been submitted. The <br />original plan was approved on January 9, 1992, and was most recently renewed on May 23, 2003. <br />Mining has been completed at the East Rigden site and construction of a clay reservoir liner <br />~. is proceeding in the southeast portion of the property. In addition, mined material is no longer <br />conveyed from the adjacent Resource Recovery Farm site to be processed at the East Ridgen <br />facility. <br />The exposed acreage has decreased to 23.2 acres, which includes 0.3 acres of dewatering <br />trench. According to previously submitted information, 25 acres of water surface was exposed within <br />the reclamation permit boundary prior to January 1, 1981. Since the current exposed area is less <br />than the area exposed prior to January 1, 1981, there is no longer an evaporation augmentation <br />requirement at this site. <br />The anticipated consumptive use at this site consists of 1 acre-footfordust suppression and <br />0.08 acre-feet for the office/asphalt production plant septic system. The replacement requirement <br />forthis approval period is 4.8.acre-feet, which accounts forthe lagged depletionsfrom consumptive <br />used during this plan period and lagged depletions accruing to the river from previous operations. <br />The proposed sources of replacement water for this pit is one Box Elder Ditch share which <br />will be recharged into a 7.9-acre pond located on the property. The one Box Elder Ditch share is part <br />of the 8 shares that were historically used to irrigate 222.7 acres of com, alfalfa and pasture grass at <br />the East Rigden site, which have been taken out of the production. The historic consumptive used of <br />the 8 shares was determined to be approximately 327.3 acre-feet. The pro-rata consumptive use for <br />one share is 40.9 acre-feet. <br />A monthly breakdown of depletions and replacements is shown on the attached Table. The <br />Table indicates that although the total consumptive use from the mining operation is currently 1.08 <br />acre-feet, this plan will make replacements for 4.8 acre-feet to account for lagged depletions from <br />previous consumption at the site. Well permit no. 53509-F was obtained for the gravel pit in <br />accordance with §37-90-137(2) and (11), C.R.S. <br />
