Walther <br />Executive Director <br />Michael B. long <br />Division Director <br />On 3/1 /02, I was contacted by Minerals Program Supervisor and directed to return phone <br />inquiry from Todd Hennis (303) 569-0155 regarding the Mogul Mine. <br />The Mogul Mine is located in or near Ross Basin, in the upper watershed of Cement <br />Creek, north of Silverton. DMG briefly inspected the site during its 10/19/99 inspection <br />of the Sunnyside Mine, copy of the inspection report is filed under permit number M- <br />1977-378. <br />On 3/1 /02, I called Mr. Hennis at the above phone number. Mr. Hennis stated that he <br />was the owner of Salem Minerals and San Juan Corporation. San Juan Corporation is the <br />owner of the Mogul Mine. Mr. Hennis stated concern that the Mogul Mine is discharging <br />high quantities of metal laden water, significantly higher quantities than historic <br />discharge, due to reclamation activities conducted by Sunnyside Gold Corporation (SGC) <br />at their Sunnyside Mine. <br />According to Mr. Hennis, the Mogul Mine was active primarily from 1901 - 1909, minor <br />mining activity since that time. Historical discharge from the Mogul was approximately <br />30 - 35 gpm. Mr. Hennis stated that most of the Mogul discharge occurred as a result of <br />underground cross cut passing under or near Cement Creek. Mr. Hennis stated that <br />according to Professional Paper 359, the underground workings of the Mogul Mine <br />connect to the underground workings of the Sunnyside Mine. Mr. Hennis believes that <br />current discharge of 130 - 150 gpm has resulted from SGC reclamation efforts. <br />I informed Mr. Hennis that DMG would investigate the jurisdictional issues if he would <br />inform us of his concerns in writing. I clarified that DMG will forward copy of his <br />complaint to SGC and will attempt to resolve the jurisdictional issues. However, if DMG <br />cannot resolve the jurisdictional issues with SGC, his complaint will be scheduled for <br />formal public hearing before the MLRB. Mr. Hennis responded that he understood that <br />DMG cannot guarantee confidentiality and that he would discuss the issue with his lawyer <br />prior to submitting anything in writing to DMG. <br />
