The Division is not proposing to approve the use of a modified equation to <br />determine maximum weight of explosives per delay (4.08.6(2)). <br />VII. Disposal of Excess Spoil <br />This section does not apply to the Bowie No. 2 Mine permit application. All excess <br />material generated during surface construction or during underground mining is <br />considered to be coal mine waste, and such materials will be placed in the approved coal <br />mine waste bank. <br />VIII. Coal Mine Waste Banks <br />A. The Division approved plans for use, constmction and maintenance of a coal mine <br />waste disposal area (4.10. I (1)). <br />B. The applicant has not submitted a plan for disposal, at the approved disposal area <br />within the permit boundary, of mine waste materials generated by activities <br />outside the permit boundary (4.10. l (2)). <br />C. The disposal area will be inspected on a regular basis by a qualified professional <br />engineer, experienced in construction of similar earth and waste stmctures <br />(4.10.2(1)). <br />D. An alternative subdrainage system for the coal mine waste area has not been <br />proposed. The Division finds that the approved subdrainage system should ensure <br />the applicable static safety factor, stability of the fill, and protection of the surface <br />and ground waters (4.10.3(5)). <br />E. The Division is not proposing to approve a variation in the requirements for <br />maximum allowable lift thickness and minimum required compaction <br />(4.10.4(3)(a)). <br />IX. Coal Mine Waste <br />A. Non-coal waste will be stored at designated locations at the mine site, then <br />transported to the Delta County landfill for proper disposal. <br />X. Backfilling and Grading <br />A. Bowie Resources, Ltd., will reclaim the mine site to achieve approximate original <br />contour. All highwalls will be eliminated during reclamation. Bowie Resources, <br />Ltd., has not requested any variances regarding backfilling and grading, nor are <br />any approved with this decision document. <br />~3 <br />
