Sturges
Delaney & Balcomb
Attorneys at Law
Drawer 790 ,..
Glenwood Springs, Colorado 81601
Dear Mr. Sturges:
In response to your letter of February 19, 1980, we will meet with
Dorchester Colomine Coal at any mutually convenient time. As I discussed
with you, the permanent program regulations outline the Department's
requirements for mining and reclamation plans and permit applications.
In order to be considered "apparently complete", adequate information
to enable us to find the proposal in compliance with applicable performance
standards is required. If such information is not included, the plan
will be considered "incomplete". In certain instances, a time schedule
and detailed plan to collect data can be accepted during the initial
completeness review, provided the proposed time schedule makes adequate
information available during the related parts of the technical analysis.
With respect to your understanding regarding a mine site visit, I have
not been contacted by the Bureau of Land Management and we did not
conduct an on-site visit on February 22nd. With respect to the State-
approved plan for the Fruita Mine, that plan will be reviewed if we
are requested to provide technical assistance to the State or as a part
of the applicant's submittal for questions on federal land. We have
requested a copy of the plan from the State of Colorado.
Thank you for your letter and I look forward to a meeting.
Sincerely,
John E. Hardaway
Chief, Division of Technical
Analysis and Research
cc: Dean Massey
Chips Barry
