Morgan, Colorado 80701 <br />BE: Your unpermittad gsavel dredging operation located approximately <br />at the function of Highway 52 and I-76 in Ft. Plorgan, Colorado. <br />Dear Mr. Miser: <br />It lies come Co our attention that you are conducting an unparmitted mining operation <br />located at the Sibs, Section 31, T. 4N, R. 57W of the 6th P.M., Morgan County, Colorado. <br />We can find nothing is our records to indicate that you have applied for or obtained <br />a mining and reclamation permit from the Colorado Mixed Land Reclamation Board for <br />this mining operation. All mixing operations in the State of Colorado must be <br />permitted by the Board under authority of the Colorado Mined Land Reclamation Act, <br />Article 32 of Title 34, C.R.S. 1973, as amended (1976 Seee. Laws - H. B. 1065). <br />Several different situations may apply to your operation: (1) If your mining <br />operation vas permanently closed down before July 1, 1973, yrou need not apply to us <br />for a permit. (2) If your mixing operation is now permanently closed down but was <br />in operation after July, 1973, there are reclamation requirements which you should <br />discuss with this office, if you were mining seed and gravel, open coal, limestone <br />fos construction puspoaea or quarry aggregate. (3) If your operation is iatarmittent, <br />seasonal, or continuous during the year and, under a~ of thnae conditions, can be <br />considered preBently active, or active after June 30, 1976, it moat be permitted <br />under the Colorado Mined Land Reclamation Act. <br />If you have a mining and reclamation permit or have applied for one, please send ue <br />your permit number sad the associated correct name of your company. If you have not <br />yet applied, please consult the enclosed Rules and Regulations and submit either a <br />limited impact or regular permit application (110 sad 112 forms enclosed). <br />Please ba advised that the coneaquences of operating a mine without a permit can <br />be substantial and severe. Our desire is sot to harass bueiaeases, or cause economic <br />hardship, but to effectuate compliance with the state reclamation law by all mining <br />operators. Such a law can not bn equitable, nor can wa achia<+e reclamation at all <br />mixes, unless all operators comply.
