Long <br />Somerset, CO 81434 o~„~s~nnD~re~inr <br />RE: Mountain Coal Compaay; West Elk Mine; Permit No. C-80-007 <br />Dear Mr. Schmidt; <br />Please find enclosed a letter written to Mr. and Mrs. Mautz in <br />response to their letter addressed to me dated August 28, 1995. In <br />response to their complaint, I conducted an inspection on August <br />29, 1995 with Mr. Mautz and Norm Every. During the inspection we <br />discussed some solutions to their concerns and in reply to their <br />concerns I have summarized these solutions. Please provide a <br />letter to the Division and to the Mautzs' which confirms or denies <br />the Division's recollection of the solutions discussed. <br />It appears that subsidence has impacted the cabin. Subsidence may <br />not be complete and residual settling may occur which the Division <br />believes would affect repairs done at this time. As MCC is aware, <br />the regulations require that each person who conducts underground <br />mining activities which results in subsidence that has damaged an <br />occupied dwelling, that structure must be promptly repaired, <br />rehabilitated, restored, or replaced or provide compensation in the <br />full amount of the diminution in value resulting from the <br />subsidence. If the work to date on the Mautzs' cabin has not <br />achieved this result, additional work will be required. It is our <br />understanding that MCC and the Mautzs' are working toward this end, <br />and we will monitor the progress. We are aware that the Mautzs' <br />are not satisfied with the repairs MCC has made to the cabin to <br />date, and have discovered some additional items that require <br />repair. The Division will plan on inspecting the cabin during our <br />regular monthly inspection and report findings to other Division <br />personnel. <br />To assist the Division in determining if MCC has complied with Rule <br />4.20.3(2), MCC should provide to the Division the results of the <br />pre-subsidence survey completed on the cabin. Please send any <br />pictures, notes on construction, etc. In addition, MCC should <br />provide to the Division a copy of reports provided by contractors <br />and/or engineers regarding the repairs to the cabin. Also, MCC <br />should provide to the Division a summary of the repairs that have <br />
